TO PARTICIPATE IN THE JAGERMEISTER MEISTER CLASS PROGRAM (THE“PROGRAM”), YOU MUST: 1) AGREE TO THE INFORMATION DISCLOSED IN THE TERMS AND CONDITIONS AND SUBMIT A COMPLETED APPLICATION TO ADMINISTRATOR FOR CONSIDERATION TO PARTICPATE IN THE PROGRAM BY TUESDAY, SEPT. 15, 2020 AT 11:59 PM ET 2) RECEIVE THE WRITTEN INVITATION TO PARTICIPATE IN THE PROGRAM AND 3) AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THE PROGRAM. APPLICANT UNDERSTANDS THAT NEITHER THE ADMINISTRATOR NOR ITS AGENTS HAS ARRANGED FOR ANY EXPENSES INCURRED OF ANY KIND IN CONNECTION WITH THIS PROGRAM, WHICH ARE THE APPLICANT’S SOLE RESPONSIBILITY.
BY PARTICIPATING IN THE PROGRAM, YOU AS THE APPLICANT ACKNOWLEDGE AND AGREE THAT, IF YOU SHARE ANY IDEA, SUGGESTION OR CONCEPT AS PART OF THE PROGRAM THAT OTHERS MAY USE YOUR IDEA, SUGGESTION OR CONCEPT AND INCORPORATE IT INTO A PRODUCT THAT THEY ARE WORKING ON NOW OR IN THE FUTURE, AND YOU WAIVE ANY AND ALL RIGHTS, CLAIMS AND LAWSUITS, ARISING IN CONNECTION WITH SUCH IDEAS, SUGGESTIONS OR CONCEPTS, THAT YOU MAY HAVE AGAINST ANYONE PARTICIPATING IN THIS PROGRAM AND THE ADMINISTRATOR (INCLUDING ITS AGENTS, PARTNERS, AND VENDORS, IF APPLICABLE). YOU AS THE PARTICIPANT, ALSO REPRESENT AND WARRANT THAT YOU HAVE SUFFICIENT RIGHTS TO SHARE AND/OR DISCLOSE ANY SUCH IDEAS, SUGGESTIONS OR CONCEPTS DURING THE PROGRAM.
WHO MAY PARTICIPATE: Program is open to legal residents of the fifty (50) United States (U.S.) and District of Columbia (D.C.) who are 25 years of age or older and have applied prior to Tuesday, September 15, 2020 at 11:59pm ET and were invited to participate in the collaboration (“Collaboration”). Invitation to participate in the Collaboration cannot be transferred to another person. Employees and agents of the Administrator, Interscope Records (a division of UMG Recordings, Inc. 2220 Colorado Ave., Santa Monica, CA 90404) and their respective affiliates, subsidiaries and parent companies, and advertising and promotions agencies (collectively the "Released Parties"), licensed alcoholic beverage distributors and retailers, and their immediate families (spouses, parents, siblings, children and their spouses) are not eligible to participate. Void outside 50 U.S. and D.C. and where prohibited by law.
By submitting an application, each Applicant acknowledges and agrees that Administrator may obtain many applications under this Program and that such applications may be similar or identical in theme, idea, format or other respects to others submitted under this Program , and waive any and all claims Applicant may have had, may have, and/or may have in the future, that any application accepted, reviewed and/or used by the Administrator (or its respective designees) may be similar to his/her application. Applicant acknowledges and agrees that the Administrator does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright and/or other intellectual property rights in and to Applicant’s application.
APPLICATION CONTENT GUIDELINES: Applications that do not meet the following “Content Guidelines” are subject to disqualification from consideration in Program at the Administrator’s sole discretion:
1. Application: a) must be the original work of the Applicant; and b) must not have been previously published.
2. Applications cannot contain any Content that infringes upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity and/or invade the privacy or publicity rights of any person, living or deceased, or the intellectual property or other rights of any person or entity. Applications determined, in Administrator’s sole discretion, to infringe on any intellectual property rights or other rights will be disqualified from consideration.
3. Applications must not include material that is: (i) is sexually explicit, indecent, obscene, unnecessarily violent, dangerous, hateful, tortuous, defamatory, slanderous or libelous, (ii) is derogatory, designed to harass or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (iv) is unlawful, (v) is disparaging to the Administrator or is inconsistent with the positive images and/or goodwill such parties have worked hard to create and wish to associate with their companies.
4. Applicants agree and acknowledge that applications will not be treated as confidential and may be made available to the public, including but not limited to posting on the Internet. Administrator does not guarantee any confidentiality with respect to any application.
GENERAL: The Released Parties are not responsible for damaged, stolen, altered, or incomplete applications, all of which will be void. Released Parties are also not responsible for problems uploading or downloading any Program-related information or materials or for any other technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, or for any other technical problems. Released Parties are not responsible for any other errors or malfunctions of any kind, whether human or otherwise relating to or in connection with the Program.
RELEASES/INDEMNITIES: By submitting an application, Applicants agree to release and hold harmless the Released Parties from any and all third party claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Program, the Administrator’s use of any of the rights granted herein or any breach by Applicant of any representation, warranty or covenant made by such Applicant in connection with the application.
PRIVACY: The Administrator may use registration information to contact Applicant about the Program and as otherwise described in these Terms and Conditions.
GOVERNING LAW & VENUE: All matters arising in connection with or relating to this Program or the enforcement or construction of these Terms and Conditions shall be governed by and resolved in accordance with the laws of the State of California, U.S.A., without regard to any conflict of law principles that would result in the application of the laws of a different jurisdiction.
